Terms & Conditions

These Terms and Conditions (“Terms”) apply to registration for and participation in Hall of Fame Dance Challenge, Inc. (referred to herein as “HOF”, “we”, “our”, or “us”) events (“Events”). If the participant (“Participant”) is a minor, a parent or legal guardian of Participant (“Parent/Guardian”) must accept these Terms.

Eligibility and Registration

By registering, you confirm the Participant meets age/category rules and that all information provided is accurate. Studios and independent dancers are responsible for timely registration and compliance with event rules posted on our website.

Conduct and Safety

All Participants agree to follow staff instructions, posted rules, and venue policies. We may remove anyone for unsafe, disruptive, harassing, or unsportsmanlike conduct, without refund.


You are responsible for your own safety and for complying with choreography, warm‑up, and footwear guidelines.


Bring valuables at your own risk. HOF is not responsible for lost, stolen, or damaged property.

Assumption of Risk; Release and Limitation of Liability

DANCE AND ATHLETIC ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING SERIOUS INJURY. PARTICIPANT (AND PARENT/GUARDIAN, IF PARTICIPANT IS A MINOR) VOLUNTARILY ASSUMES ALL RISKS. TO THE FULLEST EXTENT PERMITTED BY LAW, PARTICIPANT AND PARENT/GUARDIAN RELEASE AND FOREVER DISCHARGE THE HALL OF FAME DANCE CHALLENGE, INC., ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, SPONSORS, OTHER PARTICIPANTS, AND AGENTS (THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, AND LOSSES ARISING OUT OF PARTICIPATION OR ATTENDANCE, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. THIS RELEASE DOES NOT WAIVE CLAIMS THAT CANNOT BE WAIVED BY LAW, INCLUDING GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY LAW, HOF’S TOTAL LIABILITY TO ANY PARTICIPANT OR PARENT/GUARDIAN FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE EVENTS SHALL BE LIMITED TO THE TOTAL REGISTRATION FEES PAID BY THE PARTICIPANT FOR THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL HOF OR THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES.

Indemnity

Participant (and Participant’s Parent/Guardian, if Participant is a minor) agrees to indemnify, defend, and hold harmless HOF and the Released Parties from and against any and all claims, demands, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to Participant’s (or Parent’s/Guardian’s) actions or omissions, or Participant’s (or Parent/Guardian’s) breach of these Terms, except to the extent such claims, demands, losses, damages, liabilities, or expenses are caused by the gross negligence or willful misconduct of HOF or the Released Parties.

Photo/Video Consent

We may film, photograph, and record the event. Participant and Parent/Guardian grant us a worldwide, perpetual, royalty‑free right to use Participant’s name, image, and likeness in any media for event and company purposes.

Medical Authorization and Costs

In an emergency, we may arrange medical care we deem necessary. Participant and/or Parent/Guardian is responsible for all related costs and agrees we are not medical providers and are not liable for the acts or omissions of medical personnel.

Fees, Refunds, Changes and Non-Payment

Fees are due as stated at registration and are nonrefundable. Failure to pay fees by the deadline may result in forfeiture of registration and any associated benefits, without refund. We may modify schedules, combine/divide categories, or relocate/postpone events as needed. If an event is canceled without a reschedule, we will provide a refund of paid entry fees as the sole remedy.


All fees and any stated balances are due by the payment deadlines. If amounts are not paid when due, we may, in our discretion, cancel, revoke or refuse entries, deny check‑in or performance, withhold scores or awards, and suspend participation until all amounts are paid. Past‑due amounts will accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law. You are responsible for reasonable costs of collection of unpaid or past-due events, including attorneys’ fees and third‑party collection‑agency fees, as permitted by law. We may assess a returned‑payment/chargeback fee and may set off unpaid amounts against any refunds or credits owed.

Force Majeure

We are not liable for delays, changes, or cancellations due to causes beyond our reasonable control (including, but not limited to, severe weather, venue issues, public health directives, venue owner or operator decisions, or government action).

Awards and Discretion

Scoring, adjudication, and awards are in the sole discretion of our judges and staff and are final.

Minors and Supervision

A parent/legal guardian must accept these Terms for any Participant under the age of 18. A responsible adult must supervise minors at all times; we are not responsible for supervision or childcare. If any pre‑injury release for a minor is not enforceable under applicable state law, these Terms still apply to the Parent/Guardian to the fullest extent permitted.

Dispute Resolution; No Class Actions

Any dispute arising out of these Terms or the event will be resolved through binding individual arbitration under the AAA Consumer Arbitration Rules, with hearings by video or in the county of the participant’s residence, unless we agree otherwise. You may bring an individual claim in small‑claims court instead. No class, collective, or representative actions or arbitrations are permitted. We will pay arbitration administrative and arbitrator fees beyond any nominal consumer filing fee, as required by the applicable rules. This section does not limit any rights that cannot be limited by law.

Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑laws rules. However, non‑waivable laws of the state where the Event is held or where an injury occurs will apply to personal‑injury issues, including the enforceability and scope of any release or waiver of liability and the rights of minors. Courts in Florida or in the state where the Event is held have exclusive jurisdiction to enter judgment on an arbitration award and for any permitted small‑claims matters.

General

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, such provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will continue in full force and effect. The invalidity or unenforceability of any provision will not affect the validity or enforceability of any other provision. These Terms, together with any posted event rules, registration-specific terms, and any written policies or guidelines referenced herein, constitute the entire agreement between you (and, if applicable, your Parent/Guardian) and Hall of Fame Dance Challenge, Inc. regarding registration for and participation in the Events. These Terms supersede all prior or contemporaneous agreements, understandings, negotiations, or communications, whether written or oral, relating to the subject matter herein. No amendment, modification, or waiver of any provision of these Terms will be effective unless it is in a written document expressly identified as an amendment, modification, or waiver, and signed by an authorized representative of Hall of Fame Dance Challenge, Inc.. No failure or delay by HOF in exercising any right, power, or remedy under these Terms will operate as a waiver of such right, power, or remedy, nor will any single or partial exercise of any such right, power, or remedy preclude any other or further exercise of such right, power, or remedy. You acknowledge and agree that you have not relied on any statement, representation, warranty, or agreement of HOF or any other person on behalf of HOF, except for those expressly set forth in these Terms. If there is any conflict between these Terms and any other document or communication, these Terms will control unless otherwise expressly stated in a signed writing by HOF. By proceeding with registration or attending any Event, you explicitly acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms. For any Participant who is a minor, the Parent/Guardian’s act of registration or allowing attendance serves as their full and binding agreement on behalf of the minor, affirming their acceptance of all provisions herein, including the Parent/Guardian’s liability for the acts of the Participant and otherwise as set forth herein.
